The rules that apply when you buy from holdformusa.com.

1. Who you are buying from

Holdform is a brand of GG4LAB SRL, Via Covalova 11, 95019 Zafferana Etnea (CT), Italy. VAT number IT06208500873. You can reach us at gg4lab@gmail.com.

In these terms, "we", "us" and "Holdform" mean GG4LAB SRL. "You" means the person using this website or placing an order.

2. Accepting these terms

By browsing this website or placing an order you accept these terms. If you do not accept them, please do not use the site.

You must be at least 18 years old and able to enter a binding contract to order from us.

3. What the product is, and what it is not

We describe the cushion as accurately as we can, but comfort is personal. That is exactly why the 60-day trial exists: try it and send it back if it is not right for you.

4. Prices and currency

All prices are in US dollars. Shipping is free within the 48 contiguous United States.

We may change prices, run promotions, or end them at any time. The price that applies to your order is the one shown at checkout when you place it. If a price is shown with an obvious error, we may cancel the order and refund you in full rather than honour it.

5. Orders

Your order is an offer to buy. The contract is formed when we send you the shipping confirmation email, not when you click the button or receive the order confirmation.

We may refuse or cancel an order, and refund you in full, if:

• the item is unavailable or the price was wrong;
• the delivery address is outside the area we ship to;
• we suspect fraud or an unauthorised payment;
• the order looks like it is for resale rather than personal use.

6. Payment

Payments are processed by Shopify and the payment providers shown at checkout. We never see or store your full card number. By paying you confirm you are entitled to use the payment method.

7. Shipping, delivery and risk

We ship to the 48 contiguous United States. We do not ship to Alaska, Hawaii, Puerto Rico, US territories, or outside the United States. If you order from one of those, we refund you.

Delivery estimates are estimates, not guarantees, and carrier delays are outside our control. If we cannot ship your order within 30 days of your payment, we will contact you and you may cancel for a full refund. Full details are on our Shipping page.

Risk of loss passes to you on delivery. If a parcel is confirmed lost by the carrier, we replace it or refund you.

8. Returns and refunds

You have 60 days from delivery to return the cushion for a refund of the product price. It can be used, and you do not need the original box. Email us and we send a prepaid return label.

This is more generous than the law requires and it does not replace your statutory rights. The full procedure is in our Cancellation, return & refund policy.

9. Warranty and disclaimer

We warrant that the cushion will be free from manufacturing defects in normal domestic use for 12 months from delivery. Normal wear, damage from misuse, cutting, washing the foam core, or use outside the product's purpose are not covered.

Beyond that warranty and your non-waivable statutory rights, the site and the products are provided "as is". We do not promise that the website will be uninterrupted or error-free.

10. Limitation of liability

To the extent the law allows, our total liability to you for any claim connected to an order is limited to the amount you paid for that order.

We are not liable for indirect or consequential losses. Some US states do not allow the exclusion of incidental or consequential damages, so this limit may not apply to you in full.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.

11. Using the website

Do not attempt to break into, overload, scrape at scale, or interfere with the site, and do not use it for anything unlawful.

The Holdform name, the site design, the text and the product photography belong to us and may not be copied for commercial use without written permission. Reviews or photos you send us may be published on this site, with your first name and last initial, unless you ask us not to.

12. Privacy

How we handle your personal data is described in our Privacy policy, which forms part of these terms.

13. Changes

We may update these terms. The version that applies to your order is the one published when you placed it. The date at the top shows when this version was published.

14. Governing law and disputes

These terms are governed by Italian law, and the courts of Catania, Italy, have jurisdiction.

If you are a consumer, this does not take away the protection of the mandatory consumer laws of the US state where you live, and you can also bring a claim in your local courts.
